Administrative Waivers

Administrative waivers for setbacks may be granted by the Planning and Zoning Director under specific circumstances described below.

Protected Trees

The Planning and Zoning Director may reduce front, side, or rear setback requirements established by the Land Development Regulations (LDR) Zoning Code to preserve a hardwood tree with a minimum diameter at breast height (DBH) of 12 inches.

Error in Structure Placement

A waiver of up to three feet may be approved when an error in structure placement has occurred and correcting or removing the structure would create an undue hardship for the property owner or builder.

Application Requirements

If you believe your situation meets one of these criteria, you may submit an application to the Clay County Planning and Zoning Division. Most applications are reviewed within approximately two weeks.

Required Documents

  • Completed application
  • Property Owner Affidavit (included with the application)
  • Survey showing the setback error or protected tree location

Review Process

After all required materials have been received, the Planning and Zoning Division will review the request.

If the request is denied, the applicant will receive written notification of the decision. If approved, the applicant will receive a letter and waiver document that must be recorded with the Clerk of Court at the applicant's expense.
