What to Know Before You Buy into a Homeowner Association (HOA)
Once you have identified a home you are interested in, ask your real estate agent whether the property is part of a homeowner association or subject to deed restrictions. If so, consider taking the following steps:
- Obtain copies of the governing documents from the association manager or from your local Clerk of Court. If you do not understand the rules, ask your real estate agent or an attorney for assistance.
- Speak with current residents to learn about their experience with the association.
- Understand the amount of the association assessments.
- If you are on a tight budget, ask how easily the board can increase the assessment amount.
- Determine whether the community maintains a reserve fund for future projects.
- Find out whether there are restrictions on renting your property.
- Review the architectural guidelines and determine whether you are comfortable with them.
- Understand the rules regarding pets, flags, satellite dishes, fences, patios, and home businesses.
- If considering an age-restricted community, review the policies regarding underage residents and visitors.
- Consider whether the association’s rules align with your lifestyle and expectations for community living.
HOAs Commonly Regulate
- Roofing materials, shingles, and exterior paint colors.
- Fences and hedges, including permitted types, colors, and height requirements.
- Trees, lawns, and weeds, including landscaping standards and maintenance expectations.
- Pools, including whether they are allowed, permitted sizes, and rules for community pools.
- Swing sets and basketball hoops, which may be restricted or required to be placed out of sight.
- Garages and sheds, including rules regarding storage, shed placement, and garage appearance.
- Mailboxes and garbage containers, including approved types, sizes, and storage requirements.
- Pets, including size, type, breed restrictions, and leash requirements.
- Outdoor lighting, including seasonal or decorative lighting and how long it may remain in place.
