Proposed Ordinance’s Title:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF CLAY COUNTY, FLORIDA, AMENDING ARTICLE IV, SOLID WASTE DISPOSAL ASSESSMENT, AND ARTICLE V, SOLID WASTE COLLECTION, OF CHAPTER 10, GARBAGE AND TRASH, OF THE CLAY COUNTY CODE, TO AMEND SECTION 10-111.1 OF ARTICLE IV, ADOPTED BY ORDINANCE NO. 99-9, AND SECTION 10-146 OF ARTICLE V, ADOPTED BY ORDINANCE NO. 2006-53, EXEMPTION FOR SERVICE CONNECTED TOTAL AND PERMANENT DISABILITY AND DEATH, TO REDUCE THE VETERANS EXEMPTION FOR THE DISPOSAL ASSESSMENT AND THE COLLECTION ASSESSMENT TO 50% OF EACH ASSESSMENT; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.
This Business Impact Estimate is provided in accordance with Section 125.66 (3), Florida Statutes.
1. A summary of the proposed ordinance, including a statement of the public purpose to be served by the proposed ordinance, such as serving the public health, safety, morals, and welfare of the County:
The proposed ordinance is to amend the Clay County Ordinances concerning solid waste disposal and collection assessments, to reduce the veterans exemption from 100% to 50%. There are two assessments associated with solid waste: 1) a $262 assessment for curbside pick-up of solid waste; and 2) a $96 assessment for disposal of solid waste to a location outside of the County. Currently, “any real estate that is owned and used as a homestead by a veteran who was honorably discharged with a service connected total and permanent disability . . . is eligible to receive payment of the solid waste collection [and disposal] assessments by the county on his or her behalf.” The proposed Ordinance would decrease the amount paid by the County from a total of $358 to $179 for eligible veterans.

The regulatory costs borne by the County attributable to this proposed Ordinance will be de minimus and no new charges or fees will be imposed on businesses as a result.

This Ordinance pertains only to individuals with a service connected total and permanent disability; therefore, no Clay County businesses will be impacted.
